CBA TERMS & CONDITIONS

1. General Overview

1.1. These Terms and Conditions apply to all CBA offerings, including but not limited to Business Basics, 1:1 Coaching, Mastermind Programmes, and The Pod Classes Membership.
1.2. We reserve the right to update these terms. Changes will be communicated via email or through our website.

2. Programme + Payment Details
- Payment Terms: Full payment or an agreed installment plan must be completed before the program start date.
- 14-Day Guarantee: You may withdraw within 14 days of enrollment for a full refund. After this period, no refunds will be issued.
- Please note that if a payment is missed on any payment plan, access to the program will be paused until the outstanding payment is received. If we are unaware of the missed payment, a £29 administration/late payment fee will be added to the balance.

2.1 Business Basics Programme
- Business Basics is a 12-month group coaching programme. By enrolling, you agree to a minimum commitment of 12 months. - The programme includes access to the core curriculum (modules, workbooks, and recorded materials), scheduled group coaching calls, and a private community space.
- Group coaching calls are scheduled in advance by CBA. It is your responsibility to attend live if you wish to take part.
- Calls are recorded and stored within the Business Basics course platform. You will have access to all recordings for the duration of your 12-month programme.
- If you do not attend a live call, you may catch up via the recording. No replacement, refund, or credit will be offered.
All modules and workbooks remain available for the duration of your contracted term.

2.2 1:1 Coaching
- The 1:1 Coaching Programme is a 12-month package that combines full access to the Business Basics programme (as outlined in 2.1) with additional private coaching.
- You will be assigned a primary coach (Jo or Vicky) for the duration of the programme. You will receive one private coaching call per month with your coach.
- Calls are scheduled in advance and must be taken within the month. At least 48 hours’ notice is required to reschedule. Calls missed, cancelled late, or repeatedly rescheduled will be forfeited.
- In the event of sickness, illness, or circumstances beyond control, we will always do our best to maintain your call at the scheduled time. Where appropriate, the other coach may step in to deliver the call so your support is not interrupted.
- Unused calls cannot be rolled over, refunded, or credited.
- You will also have ongoing WhatsApp/email access for business support during your contracted term.
- All Business Basics terms in section 2.1 apply in full.

2.3 Pod Classes (Patreon)
- Pod Classes is a rolling monthly subscription delivered via the Patreon platform.
- Payment and billing are managed directly through Patreon in line with their terms and policies. By subscribing, you also agree to Patreon’s own terms of service and payment processing rules.
- The subscription is charged monthly in advance at the advertised rate.
- You may cancel at any time through your Patreon account. No refunds or partial refunds are given for unused portions of a month.
- Access to the Pod Classes audio library is only available while your Patreon subscription remains active. If you cancel or your payment fails, access will stop immediately.
- Pod Classes is a standalone subscription and does not include access to Business Basics, 1:1 coaching, or any other CBA services.

3. Communication & Response Times
- CBA aims to respond to all queries, tasks, or materials within three (3) working days.
- Our official working days are Monday to Friday, excluding public holidays. While we may occasionally respond outside of these hours at our discretion, this should not be expected or relied upon.

3.1. Communication Channels
- 1:1 Coaching: WhatsApp support is included, with all messages responded to within three (3) working days.
- Business Basics: Support is provided via the dedicated Facebook group and email (hello@caninebusinessacademy .com).
- Responses will be within three (3) working days.
- Pod Classes: Pod Classes do not include group or 1:1 support. Any queries relating to billing or access should be sent via email (hello@caninebusinessacademy .com), and responses will be within three (3) working days.
- Any previous use of WhatsApp (e.g., for sales conversations) should not be used for programme support, as it will not be monitored or responded to.

Important Notes:
- Communication outside of agreed channels (e.g. WhatsApp, email, Facebook groups) may not be monitored.
We strive for faster responses, but response times are not guaranteed. Urgent requests should not be assumed unless expressly agreed in advance.
- Programme Facebook groups are available 24/7 for peer-to-peer support, but CBA does not guarantee constant monitoring or immediate responses.

4. Client Responsibilities & Participation
- Business Basics (BB) Clients
- Attend all scheduled group coaching calls live where possible.
- If you cannot attend, it is your responsibility to watch the call recording.
- All group calls are recorded and uploaded to the course platform within 24 hours of the live session.
- Complete assigned workbooks, tasks, and pre-work to gain maximum benefit.
- Failure to attend live calls, watch recordings, or complete workbooks cannot be used as grounds for refund requests, complaints, or claims of dissatisfaction.

1:1 Coaching Clients
- Provide at least 48 hours’ notice if you need to reschedule a session. Missed sessions without notice will be forfeited.
- If CBA needs to reschedule for any reason, your session will always be rearranged- no session will ever be lost.
- Complete any agreed pre-work or tasks prior to calls.
- General Client Responsibilities (all programmes)
- Engage fully with the programme(s) to gain the maximum benefit.
- Take responsibility for implementing advice, strategies, and actions within your business. Respect communication boundaries and response times outlined in Section 3.

CBA’s Role
- CBA provides coaching, mentoring, and strategic guidance.
- We supply tools, strategies, and frameworks, but implementation remains the client’s responsibility.
- We are not responsible for carrying out business tasks on your behalf (e.g. marketing, admin, or client delivery).

Outcome Disclaimer
- While our programmes are designed to help you grow your business, results cannot be guaranteed. Individual outcomes depend on your own commitment, implementation, and external factors beyond our control.

4.1. Professional Boundaries and Peer Participation
- Canine Business Academy is a business support service, not a provider of technical training in canine behaviour.
- Canine Business Academy are not method-neutral: we work with dog professionals who prioritise welfare, consent, and relationship-based practice, and we do not support the use or public promotion of coercive tools or force-based methods.
- Our focus is on business development. Coaching spaces (including group calls, 1:1 sessions, and programme groups) are strictly for business strategy, marketing, sales, and operations. We do not provide, and will not host, training advice or methodology debates.
- In rare cases, we may accept clients who are actively transitioning away from the use of aversive tools (e.g. e-collars, prong collars) and who demonstrate a genuine commitment to change. Participation in these cases is conditional and includes:
- Transparency around current methods and intent to evolve.
- A commitment to avoid public endorsement or promotion of coercive tools while enrolled in a CBA programme.
- Agreement that any breach of these terms (such as the publication, promotion, or endorsement of coercive tools or methods) will result in immediate removal from the programme with no refund.
- Respectful engagement with other participants is expected at all times. Discussion should remain focused on business, the dog training marketplace, and personal business development. Disagreement with the views, methods, or identities of others is not grounds for cancellation or refund.
- By enrolling, you agree to uphold the ethos of CBA and contribute to a values-led, professional, business-focused environment.

5. Cancellations and Refunds
5.1 Business-to-Business Purchases
- All Programmes, services, and products provided by Canine Business Academy (“CBA”) are supplied strictly on a business-to-business (B2B) basis.
- CBA does not contract with consumers.
- Enrolments are made in the course of business and consumer protection legislation (including the Consumer Contracts Regulations 2013) does not apply.

5.2 14-Day Refund Policy (Goodwill)
- As a gesture of goodwill, CBA offers a 14-day money-back guarantee on Business Basics and 1:1 Coaching enrolments. The period begins the day after purchase and applies whether you pay in full or by instalments. To request a cancellation within this window, email hello@caninebusinessacademy.com with your full name, date of purchase, programme enrolled in, and reason for cancellation. (We may request bank details to process the refund.) CBA may amend or withdraw this goodwill policy at any time.

5.3 Digital Content and Early Access
- By enrolling in any Programme that includes immediate access to digital content (e.g., Business Basics modules, recordings, or Pod Classes), you agree to early supply of digital content, which may waive statutory cancellation rights under Regulation 37(1)(a) of the Consumer Contracts Regulations 2013.

5.4 After 14 Days
- After the 14-day period, no refunds will be issued and the full programme fee remains due, whether you chose to pay in full or by instalments.

5.5 Payment Authority
- It is the purchaser’s responsibility to ensure the person completing the transaction has authority to bind the business. Any discretionary refunds outside the 14-day window remain solely at CBA’s discretion.

5.6 Business Basics (12-Month Programme)
- Business Basics is a fixed 12-month programme. By enrolling, you commit to the full 12-month term and fee. No refunds or partial refunds will be issued if you choose not to complete the programme. If you do not attend live group calls, it is your responsibility to watch the recording (uploaded to the course platform within 24 hours of each call).

5.7 1:1 Coaching Sessions
- 1:1 sessions must be rescheduled with at least 48 hours’ notice. Sessions cancelled or rescheduled with less than 48 hours’ notice are forfeited and are not refundable or transferable. If CBA needs to reschedule (e.g., illness/emergency), the session will always be rearranged at a mutually convenient time and will not be lost.

5.8 Pod Classes (via Patreon)
- Pod Classes is hosted via Patreon. You may cancel at any time via your Patreon account. Access continues until the end of your current billing cycle. No refunds are issued for unused time once a billing period has started. Billing and cancellations are governed by Patreon’s terms.

5.9 Payment Plans and Outstanding Balances
- Payment plans are provided solely to spread the cost. They are not subscriptions and do not limit your liability for the full programme fee. By enrolling, you agree to pay the full fee, whether in one payment or by instalments.

If any instalment is missed, cancelled, or fails:
- The outstanding balance becomes immediately due;
- CBA may suspend access to calls, content, and support until payment is received; An administration fee of £29 per failed payment will be added;
- CBA may use debt recovery services or commence legal proceedings to recover unpaid fees, and you will be liable for reasonable recovery costs;
- Any chargeback or payment dispute raised without prior written notice to CBA will be treated as a breach of contract and subject to the above recovery terms.
- Cancelling or failing to complete a payment plan does not constitute valid cancellation of your agreement and does not release you from your contractual payment obligations.

5.10 Events, Conferences, and Workshops
- Refunds/cancellations for live events are governed by Event Terms and Conditions provided at ticket purchase (covering transfers, cancellations, schedule changes, and media use). Those terms override this Section 5 where applicable.

6. Bonuses and Time-Sensitive Offers
- From time to time, CBA may include time-limited bonuses or special incentives as part of a Programme or promotional offer.
- These are provided entirely at CBA’s discretion and:
- May be available for a fixed time only, as communicated at the point of offer; Cannot be exchanged for cash, credit, or alternative services;
- Are not guaranteed components of any Programme unless explicitly confirmed in writing at the time of purchase;
- May be amended or withdrawn at any time without liability.

7. Intellectual Property
7.1 Ownership
- All materials, resources, templates, recordings, and content provided by CBA (the “Materials”) remain the sole intellectual property of CBA.

7.2 Licence
- Clients are granted a non-exclusive, non-transferable, revocable licence to use the Materials solely for their own business use during their enrolment.

7.3 Restrictions
You may not:
- Reproduce, copy, share, distribute, sell, or sublicense the Materials in any form;
- Use the Materials to create derivative works, competing products, or to deliver training/coaching to others;
- Share recordings of group or 1:1 sessions without prior written consent from CBA.
- Any unauthorised use of the Materials constitutes a breach of these Terms and may result in immediate termination of access and/or legal action.

8. Limitation of Liability
8.1 General
- CBA provides strategies, tools, and guidance intended to support your business growth.
Results are not guaranteed and depend on your own implementation, circumstances, and external factors outside CBA’s control.

8.2 Exclusions
- To the maximum extent permitted by law, CBA will not be liable for:
- Loss of profits, revenue, or anticipated savings; Business interruption or loss of contracts;
- Indirect, incidental, or consequential losses;
- Decisions or outcomes made by you based on advice provided.

8.3 Cap on Liability
- CBA’s total aggregate liability, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount paid by you for the specific Programme giving rise to the claim.

9. Confidentiality
9.1 CBA’s Commitment
- CBA respects your confidentiality and will not disclose information shared in coaching or group settings, except where:
Required by law;
- Necessary to protect our rights or property; You have given prior written consent.

9.2 Client Responsibility
- Participants agree to maintain confidentiality within group sessions and private communities, including:
- Respecting the privacy and business information of other clients;
- Not sharing or disclosing other participants’ contributions without their express consent.

9.3 Recordings
- Group Calls: All group coaching calls (e.g. Business Basics) are recorded and stored in the Business Basics course platform.
- These recordings are accessible to enrolled clients for reference and review.
- 1:1 Calls: Coaching calls delivered on a 1:1 basis may also be recorded. These recordings are stored securely and made available only to CBA and the individual client for reference. They will not be shared with third parties or other clients.
- By participating, you consent to the recording and storage of sessions in line with this policy.

10. Data Protection & Privacy
- CBA is registered with the Information Commissioner’s Office (ICO) as a data controller and complies with its requirements.
- Your personal data will be processed in accordance with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
- Data will be stored and managed within secure, compliant CRM and communication systems.
- We will only collect, use, and store data necessary for the provision of our services, programme administration, and legal obligations.
- We will not share your personal data with third parties without your consent, except where required by law.
Marketing Communications
- By enrolling in a CBA programme, you consent to receive essential service communications relating to your enrolment, payments, and programme participation.
- You may also choose to opt-in to receive marketing updates, newsletters, and promotional content. Consent for marketing communications can be withdrawn at any time by clicking “unsubscribe” in our emails or by contacting us at hello@caninebusinessacademy.com.
- Withdrawing from marketing communications does not affect your receipt of essential service communications.

Data Retention
- CBA will retain your personal data only for as long as necessary to fulfil the purposes for which it was collected, including programme delivery, legal, accounting, or reporting requirements.
- Core client records (enrolment details, agreements, payment history) are retained for a minimum of six (6) years in line with HMRC and financial record-keeping obligations.
- Programme-related communications and call recordings may be retained for up to twelve
(12) months after the end of your enrolment, unless you request earlier deletion (where legally permissible).
- Marketing data is retained until you withdraw consent or unsubscribe.
- After the applicable retention period, your data will either be securely deleted or anonymised for research and business analysis purposes.

11. Governing Law
- These Terms and Conditions, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales. The parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.

12. Force Majeure
- CBA shall not be liable or responsible for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond its reasonable control, including (but not limited to) acts of God, illness, epidemic or pandemic, internet or software outages, strikes, lockouts, industrial disputes, war, terrorism, fire, flood, storm, earthquake, or changes in law or regulation. In such circumstances, CBA will make all reasonable efforts to resume services as soon as practicable.

13. Termination of Agreement
13.1 CBA-Initiated Termination
- CBA reserves the right to suspend or terminate a client’s participation in any programme or service, with immediate effect, if the client breaches these Terms, fails to make required payments, engages in behaviour deemed abusive, discriminatory, or damaging to the ethos of CBA, or otherwise disrupts the learning environment. In such cases, no refunds will be issued and all outstanding payments will remain due, in line with Section 5 (Cancellations and Refunds). Recovery of unpaid amounts may include legal or debt collection action as outlined in Section 5.10.

13.2 Client-Initiated Termination
- If a client chooses to end their participation in any programme or service early, Section 5 (Cancellations and Refunds) will apply. Termination does not release the client from their contractual payment obligations, and all outstanding payments will remain due, with recovery processes enforceable as per Section 5.10.

14. Acceptance of Terms
- By making payment for any Programme, service, or product provided by Canine Business Academy, you confirm that you have entered into this agreement in the course of business and accept these Terms and Conditions.
If, upon receiving a copy of these Terms, you do not agree to them, you may exercise the 14- day refund policy set out in Section 5. After this period, all payments remain due and no refunds will be issued.

15. £50k Guarantee
15.1 Overview
- CBA offers a results-based guarantee for Business Basics and 1:1 Coaching clients. If you complete your 12-month programme in full and do not generate at least £50,000 in gross business revenue in the business you are actively developing under CBA guidance during that period, CBA will continue to provide coaching support at no additional cost until you reach that milestone.
This guarantee applies only to clients who commit fully to the 12-month programme. Dedication, consistency, and full participation are essential.

15.2 Eligibility Criteria
To qualify for this guarantee, you must have:

- Attendance: Attended a minimum of 90% of scheduled live group calls across the 12-month programme (equivalent to at least 43 of 48). Live attendance is required because these sessions are interactive coaching environments and participation in real time is critical to results. In exceptional circumstances (e.g. illness, bereavement), prior notice must be given to CBA, and replays may be accepted at CBA’s discretion. Attendance will be verified using Zoom records.
- Modules: Engaged with all programme modules, with progress verified by course platform login records.
- Implementation: Taken reasonable and timely action on the strategies developed with CBA, demonstrated through activity in your business (e.g. published content, offers launched, client acquisition, or other evidence of implementation).
- Engagement: Contributed to the private client Facebook group at least twice per month.
Contributions may include asking questions, sharing updates, posting wins or sales, seeking feedback, or offering support to peers. A single emoji or non-substantive post will not meet this requirement.
- Wins & Sales: Shared wins, sales, or business milestones regularly in the Facebook group so that your progress is visible and can be celebrated in real time.
- Support Requests: Raised issues in a timely manner (within the same calendar month of the issue arising). Claims of “nothing has worked” raised only at the end of the programme will not qualify.

15.3 Exclusions
The guarantee will not apply where:

-You fail to meet the eligibility criteria set out in 15.2; You do not actively implement agreed strategies;
-You breach these Terms or fail to meet your payment obligations.

15.4 Continuing Support
- Where the guarantee applies, CBA will continue to provide coaching support until the £50,000 milestone is reached. The format and frequency of this support will be determined by CBA acting reasonably and in good faith. Participation in additional CBA programmes, products, or events is optional and not required to qualify for this guarantee. Such purchases do not alter or affect your rights under this guarantee.

15.5 Fair Review
- CBA will review eligibility fairly and reasonably against the criteria set out in 15.2. In the event of dispute, both parties agree to act in good faith to resolve the matter.

16. Variation of Terms
- CBA reserves the right to update or amend these Terms and Conditions from time to time to reflect changes in our services, business operations, or legal requirements. The most current version will always be available on our website. Where material changes are made that affect your Programme, you will be notified by email. Continued participation in the Programme following such notification constitutes acceptance of the updated Terms.
